River Meter - Terms and Conditions
River Meter provides streaming data service that is dependent not only on the USGS network of river gauges but the complex interpretation of that data on a timed basis on the River Meter servers.
In so far as we can determine the USGS will continue to provide this data in a format that is interpretable. River Meter will attempt to provide its customers the stream or data feeds for the foreseeable future as well as adapt to changes in the future.
River Meter subscribers are requested to put the following disclaimer on their web sites:
Please be aware that interruptions in this River Meter data service ARE likely for many reasons including but not limited to: Sensor or Gauge Failures, Sensor Misreads, Network Failure, Weather, Floods, Flood Control Activity, Construction, Ice, Snow, River Obstructions, Computer Failures, Logic Failures, Changes in Data Format and acts of God all beyond our control.
The user of River Meter information must use their own best judgment and common sense and never put themselves at risk without consulting local boating and swimming experts. You use this information at your own risk. Please boat safely follow all local boating laws and use all designated boat safety equipment.
LIABILITY:
Limitation of usability and damages. Your exclusive remedy and the entire liability of River Meter for any reason shall be limited to the amount paid by you for the River Meter subscription or its authorized reseller. To the maximum extent permitted by applicable law, River Meter and its representatives are not liable for any indirect, special, incidental, or consequential damages whether based on breach of contract, breach of warranty, tort (including negligence), product liability or otherwise, even if River Meter or its representatives have been advised of the possibility of such damages, and even if a remedy set forth herein is found to have failed of its essential purpose. Third party content providers are not responsible to you for any damages or losses arising from any use of the content. River Meter and its representatives'' total liability to you for actual damages for any cause whatsoever, will be limited to the amount paid by you for the River Meter subscription. Some states do not allow the limitation and/or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you. The limitations of the damages set forth above are fundamental elements of the basis of the bargain between River Meter and you. River Meter would not have been able to provide the River Meter subscription to you without such limitations.
INDEMNIFICATION:
You agree to indemnify River Meter, and its subsidiaries, affiliates, officers, employees, agents, co-branders, and other partners and hold them each harmless from any and all claims or demands, including attorneys'' fees, made by any third party due to or arising from your use of the River Meter service or in connection with the River Meter web site or your violation of these terms and conditions, or arising from your violation of any rights of a third party.
River Meter, RVPM Designs and the owners of this web site are not liable for your injuries or damages during boating risks you take based upon provided data. In any case the total damages may not exceed the cost of the River Meter subscription.
